The petitioner apprehends his arrest in connection with Ghosi P.S. Case No. 169 of 2017 registered under Sections 366 of 494 of the Indian Penal Code.

The accusation is that the daughter of the informant had gone to Kali Asthan temple on 09.07.2017 but did not return. Thereafter, search was made and in course of search, informant came to know that petitioner enticed away his daughter for marriage while petitioner is already married one. When the informant approached to his family members during course of search, they also abused him.

No.63637 of 2018(3) dt.31-01-2019 2/2 The learned counsel appearing on behalf of the petitioner submits that in fact, after lodging the present case, victim girl was recovered and her statement was recorded under Section 164 Cr.P.C. in which she has made specific allegation against her own uncle for boarding her forcibly on Bolero. She has not whispered about the hand of the petitioner in her kidnapping, which is evident from Annexure-2 to the petition. Petitioner is co-villager and merely on the basis of suspicion, his name has been surfaced in the present case. He has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by them within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-I-cum-A.C.J.M., Jehanabad in connection with Ghosi P.S. Case No. 169 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) sushma/- U T
