The petitioner apprehends his arrest in connection with Gaighat P.S. Case No. 135 of 2021 registered under Sections 272, 273, 414/34 of I.P.C. and sections 30(a), 36, 41(1) of the Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. From perusal of the first information report, it is evident that the owner of the vehicle is one Amresh. Petitioner has no concern with the alleged occurrence. Further he submits that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

No.52787 of 2021(2) dt.08-04-2022 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Special Judge, Excise, Muzaffarpur in connection with Gaighat P.S. Case No. 135 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
