Case No.61 of 2013, registered for the offence punishable under Sections 135/136 of the Electricity Act.
Patna High Court Cr.Misc. No.52313 of 2013 (2) dt.08-04-2016 2/2 I have heard Mr. Shashi Bhushan Kumar Manglam, learned counsel for the petitioners, Mr. Narendra Kumar Singh, learned Additional Public Prosecutor for the State, and Mrs.
Archana Sinha, learned counsel representing Electric Supply Sub-Division, Raniganj, which is under North Bihar Power Distribution Company Limited. After some arguments, this application is disposed of with a direction that if the petitioners apply for compounding of the interest, under Section 152 of the Electricity Act, the authorized officer shall accept the compounding fee, as prescribed in the table appended thereto, and proceed for compounding of the said offence in accordance with law and in terms of a decision of this Court, in case of "Mosmat Swaran @ Swaran Vs. The State of Bihar & Anr., reported in 2012 (2) PLJR 229. With the aforesaid observation, this application stands disposed of.
