JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 25-02-2020 Heard learned counsel for the petitioner, learned counsel for the Respondent-State as well as learned counsel representing the Women Development Corporation.

The grievance of the petitioner is that instead of 12,500/- per month he has been paid Rs. 9,000/- per month for discharging the duties of Personal Assistant to the Managing Director/ CMD in the respondent-Corporation. The petitioner has served as such upon his superannuation on 31.01.2007, w.e.f. 01.02.2007 onward. The petitioner's grievance is raised having regard to the decision of the Board in its 16 h meeting,

Patna High Court CWJC No.20755 of 2011 dt.25-02-2020 2/3 wherein, approved consolidated wages were specified at the rate of 12,500/- for P.A. to MD/CMD, i.e. post on which the petitioner performed his duties.

The learned counsel representing the Corporation draws attention of the Court towards the note at the bottom of the fixation of pay range as contained in Annexure-3, the proposal in the meeting was also to the extent that the candidates were to be given remunerations commensurate to the suitability for the post. After assessment of such suitability, the consolidated wages were to be granted within a pay range, i.e. 8,000/- to 12,500/-. Four (04) grades in the pay range were fixed and upon assessment of suitability for the post, and the same was approved. The four ranges were 8,000/- per month for Grade-D, 9,000/- per month for Grade-C, 11,000/- per month for Grade-B and 12,500/- per month for Grade-A. The petitioner's pay was approved and sanctioned in Grade-C based on suitability for the post, and as such, he has rightly been allowed Rs. 9,000/- per month. Irrespective of the suitability for the post, the petitioner cannot claim any right that he must be paid Rs. 12,500/- per month.

The submission of the counsel for the respondentCorporation, from bare perusal of the Annexure-3 of the

Patna High Court CWJC No.20755 of 2011 dt.25-02-2020 3/3 writ petition and the averments made in paragraph no. 5 of the counter affidavit, merits consideration. The petitioner, therefore, is getting his due and is not in a position to assert for anything more.

The writ petition is dismissed.
