07-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Barhara P.S. Case No. 149 of 2021, registered for the offence under Section 392 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other three accused persons committed theft of Rs. 1,94,000/-, two mobile phones, one laptop and ong finger-print machine from the informant on gun point and also snatched the key of motorcycle of informant. Petitioner has been identified by the informant, as one of the person who committed theft. It is submitted on behalf of petitioner that no such occurrence has taken place and petitioner has been falsely implicated in this case. No looted article has been recovered from the possession of the petitioner and petitioner is in custody

Patna High Court CR. MISC. No.55876 of 2021(2) dt.07-12-2021 2/2 since 15.05.2021.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner has been identified by the informant, as one of the person, who committed theft of aforesaid articles of informant.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
