JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 18-02-2022 Heard the parties through video conferencing. The petitioners seek bail in anticipation of their arrest in connection with Motipur P.S. Case No. 34 of 2020 instituted for the offences under Sections 341, 324, 307, 504 and 34 of the Indian Penal Code.

Learned counsel submits that the allegations against all the petitioners are general and omnibus in nature. There is only one injury of little finger on one Dashrath Kumar which is not attributed to any particular person and there is complete over implication of all the family members.

Perused the order of the Court below, find that there is only one grievous injury of middle finger which is not attributed to any particular person and all the family members have been implicated.

Considering this fact, I am inclined to grant benefit of anticipatory bail to the petitioners and in the event of arrest they shall be released on bail subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code. (Sanjeev Prakash Sharma, J) Shamshad/- U T
