The petitioners apprehend their arrest in Thakurganj P.S. case No. 153 of 2015 under Section 307, 323, 337, 353 and other Sections of the Indian Penal Code.

The informant alleged that while he was treating the injured patients in the hospital along with doctors and hospital staff, many persons came and put hindrance in the treatment of injured. They also assaulted the staff and others. The informant saved his life by hiding himself in his own residence. The informant named the petitioners along with other accused persons

Patna High Court Cr.Misc. No.27026 of 2016 (3) dt.01-09-2016 2/2 and disclosed that they were breaking the furniture of the hospital. It is submitted that no specific allegation of assault is made against the petitioners. The informant has not disclosed the source of identification and simply named the petitioners. It appears that at the instance of enemy of the petitioners, the informant named the petitioners in the FIR. Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Firoz Akram, learned Judicial Magistrate, 1st class, Kishanganj in Thakurganj P.S. Case No. 153 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
