The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 376/313/504/34 of the Indian Penal Code.
The prosecution case is that the informant was married two years prior to lodging of the case with co-accused Rahul in a temple but the petitioners being the family members did not like the marriage and inflicted torture to the informant and, subsequently, co-accused Rahul deserted the informant. It is also alleged that co-accused Rahul is inclined to perform marriage twice and pregnancy of the informant was terminated. It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.53913 of 2015 (2) dt.27-11-2015 2/2 that the thrust of accusation is against co-accused Rahul. 164 Cr.P.C. statement of the victim girl also suggests that the thrust of accusation is against co-accused Rahul and the petitioners being parents and daughter of co-accused Rahul roped in the present case.
Considering the thrust of accusation against co-accused Rahul, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Delha P.S. Case No.192 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
