In this case, the petitioner is seeking anticipatory bail in connection with Kalyanpur P.S. Case No. 219 of 2018 registered for offence punishable under sections 30 (a) and 47 of the Bihar Prohibition and Excise Act, 2016. Allegation has been made that 921 litres of illegal liquor has been recovered from the outside house of one Fulbabu and he has disclosed the name of this petitioner as well as the petitioner has criminal history.

The learned counsel for the petitioner submits that co-accused Md. Kaiser has already been granted anticipatory bail by this Court.

Patna High Court CR. MISC. No.40866 of 2019(2) dt.03-07-2019 2/2 Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders and prays for regular bail, the court below without being prejudiced by this order, will take decision in accordance with law.
