Informant, who happens to be driver and is being engaged in a travel agency run by Satish Kumar and in such circumstance, had availed company of Subhash Kumar in a way to Muzaffarpur to Patna twice and during course thereof, he talked with him with regard to purchase of a motorcycle, whereupon Subhash Kumar disclosed that he will provide the same at a cost of Rs.25,000/-. Then on 06.04.2017, Subhash Kumar came along with his associate Ankit Kumar (petitioner) and had shown motorcycle bearing its Registration No.BR-06AJ-5532 and disclosed that for the present, he is not in possession of the papers, so he be paid Rs.10,000/- at the present moment. Even after lapse of so many months, Subhash Kumar did not return. Subsequently, he came to know that Subhash Kumar and Ankit Kumar along with Anjani Thakur had committed murder of Atul Sahi and during course thereof, this motorcycle was used, which happens to be stolen one. From the written report, it is evident that it happens to be Subhash Kumar, who had shown the vehicle, procured the money, undertook to provide the papers, which informant at the time of paying Rs.10,000/- part money, conceded. Furthermore, petitioner happens to be under custody since 31.07.2017. That being so, petitioner, Ankit Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, East Muzaffarpur in connection with Mithanpura P. S. Case No.139 of 2017.
