JUSTICE SATYAVRAT VERMA ORAL ORDER 14-02-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Dalsingh Sarai P. S. Case No.340 of 2020, instituted for the offences under Sections 304(B)/ 201/34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 30.04.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the informant alleges that her daughter was married to Krishna Kumar about 05 years back and out of the wedlock,

It is further alleged that the husband was demanding Rs.5,00,000/- from the deceased by way of dowry and the deceased on 09.11.2020 informed that she was assaulted by her husband for non-fulfilment of the demand and the same day, the deceased was killed. Accordingly, the informant alleges that the deceased was killed by her husband and the named accused persons including the petitioner.

The learned counsel for the petitioner submits that the petitioner is the mother-in-law and from the allegation as alleged, it would manifest that the thrust of the allegation is against the husband and the petitioner is living separately from her son and does not have any concern with his day to day affair in life.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in the case and is the mother-in-law and the thrust of allegation is against the husband of the deceased, the petitioner, above-named, is directed to be

No.53539 of 2021(2) dt.14-02-2022 3/3 released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Samastipur in connection with Dalsingh Sarai P. S. Case No.340 of 2020.
