JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-07-2023 The present writ petition has been filed seeking the following relief:- "1. That this is an application for issuance of appropriate writ/writs, order/orders or direction/directions for directing the respondent authorities to make the payment of the arrear of the amount of the rent in the favor of the petitioner of Rs.2,58,048/-, with up to date interest which is due from 06.01.2009 to till date for which Public Health Centre, village Narora, under Nardiganj Block, district Nawada running in the house of the

Patna High Court CWJC No.11494 of 2022(4) dt.04-07-2023 2/2 petitioner."

At the outset, the learned counsel for the respondentState has submitted by referring to paragraph no.15 and 16 of the counter affidavit, filed on behalf of the respondent no.7, that the admitted outstanding rent due to be paid to the petitioner, totaling to a sum of Rs.1,05,697/-, has already been paid to the petitioner. It is further submitted that the rent for the financial year 2022-23, amounting to a sum of Rs.10,000/-, has also been sanctioned and shall definitely be paid, within a period of one week from today. It is directed accordingly.

It is needless to state that in case the up to date payment is not made to the petitioner, the Civil Surgeon, Nawada and the District Magistrate, Nawada shall not draw their salary. At this juncture, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to agitate his subsisting grievances by approaching the learned Court of Sub-Divisional Officer-cum-Rent Controller, Nawada. Liberty so sought is granted. The writ petition stands disposed off as not pressed. (Mohit Kumar Shah, J) Saurav/- U
