2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 103(1), 109, 3(5) & 351(2) of the BNS and under Section 27 of the Arms Act.

3. The case of the prosecution is that one Vivek Kumar has fired at Nitesh Kumar due to which he died.

4. Learned counsel for the petitioner submits that the name of this petitioner is not there in the FIR. The name of this petitioner has surfaced in the statement of Jagnarayan Ravidas before police. Jagnarayan Ravidas has stated that he saw that this petitioner was running with the empty cartridge. Learned counsel further submits that main thrust of allegation is against

Patna High Court CR. MISC. No.41459 of 2025(3) dt.06-08-2025 2/2 Vivek Kumar. Only statement against the petitioner is that he was seen running with the empty cartridge. There is no allegation of any assault against this petitioner. The petitioner is in custody since 15.02.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ishipur Barahat P.S. Case No. 16 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Bhagalpur.
