JUSTICE S. KUMAR ORAL ORDER 17-01-2018 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners, who are in custody, seek bail in connection with Gardanibagh P.S. Case No. 317 of 2017 registered for the offence punishable under Sections 399, 402, 120(B) of the Indian Penal Code and Section 25 (1-b) a/26/35 of the Arms Act.
The allegation against the petitioners is that petitioners and other accused persons have assembled in a room for committing dacoity in the house of Nur Saheb and after getting secret information informant reached there and on their search one country made pistol was recovered from the possession of
Patna High Court Cr.Misc. No.437 of 2018 (2) dt.17-01-2018 2/2 Phulendra Kumar and one country made pistol was recovered from possession of Vijay Kumar.
Learned counsel for the petitioners submitted that both petitioners have no criminal antecedent and they are in custody since 16.09.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Judge XIV-Cum-A.C.J.M., Patna, in connection with Gardanibagh P.S. Case No. 317 of 2017.
