The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a), 32(ii), 34(i), 38(ii), 41(i) of Bihar Prohibition and Excise Act. 3158.370 liters of foreign liquor has been recovered from a Truck.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the said truck and has got no concern with the alleged recovery. Nothing has been recovered from the possession of this petitioner and he has got clean antecedent.

Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the

Patna High Court CR. MISC. No.43615 of 2022(2) dt.14-10-2022 2/2 event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court (Second)- cum-Additional District and Sessions Judge, Vaishali at Hajipur in connection with Mahua P.S.
