This is a petition for grant of anticipatory bail for offence under Sections 364, 365 and 34 of the Indian Penal Code. Victim, Puja Kumari, had entered into love marriage with co-accused, Nantun Sahni.
The petitioner is mother of Nantun Sahni. Allegation is that the victim has been kidnapped by the accused person, with intent to commit her murder. Though the victim is still traceless, it has come in the evidence before police that the petitioner was separate from her son.
Considering the aforesaid fact as well as the fact that the petitioner is female, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bochahan P.S. Case No. 79 of 2016 to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
