====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-09-2021 Heard the parties through virtual court proceeding. The petitioner seeks bail in a case registered for the offence punishable under Sections 376D, 302, 379, 34 of the Indian Penal Code, later on Section 411 of the IPC was added. Learned counsel for the petitioner submits that the petitioner has one criminal antecedent as stated in para-3 of this application but after verification by the S.P., Munger, 12 criminal antecedent has been found against the petitioner. This fact has not come in para-69 of the case diary. Considering the facts and circumstances of the case and the fact that the petitioner has suppressed about his criminal antecedent, without going into the merits of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Muffasil
Patna High Court CR. MISC. No.39688 of 2020(10) dt.09-09-2021 2/2 P.S. Case No. 149 of 2020 pending before the court of the learned Chief Judicial Magistrate, Munger.
However, petitioner is at liberty to renew his prayer for bail after six months.
The Superintendent of Police, Munger is hereby directed to seek an explanation from the Officer concerned of Muffasil P.S. Case No.149 of 2020, as to why and under what circumstances, he has not mentioned this fact in the case diary. The report must reach to this Court within four weeks. List this case on 08.10.2021.
