JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363, 366A and 368/34 of the Indian Penal Code and Section 12 of The Protection of Children from Sexual Offences Act.
The prosecution case is that seven girls were recovered from the orchestra group who confessed that they were brought to perform dance and singing in the orchestra group. The petitioner and co-accused Kishori Mahto were alleged to have married with two girls namely Taslima Bibi and Ruma Bibi.
It is submitted by learned counsel for the petitioner that the petitioner is the owner of the orchestra group and none of the girls were found minor, hence, no offence under Section 366 and 368 of the IPC and 12 of The Protection of Children from Sexual Offences Act is made out. A statement has been made in para 3 of
Patna High Court Cr.Misc. No.51162 of 2015 (2) dt.09-11-2015 2/2 the petition that the petitioner has no criminal antecedent. Considering the nature of accusation, it is a case for consideration of regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Bettiah Mufassil (Manuapul) P.S. Case No. 138 of 2015 pending in the court of learned 1st Addl. Sessions Judge-cum-Special Judge, Bettiah, West Champaran. Accordingly, the application is disposed of.
