JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 406/420 of the Indian Penal Code.

As per the prosecution case, petitioner neither completed the work of the informant nor did he return his money amounting to Rs.1,60,000/- with interest and thus he committed fraud with him.

Learned counsel for the petitioner submits that the petitioner has never executed any agreement for completing work of the informant and thus has not misappropriated any amount. Informant has not disclosed the nature of work and mode of payment. Petitioner is in custody since 16.10.2020.

Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Muzaffarpur in Muzaffarpur Town Police Station Case No. 424 of 2020.
