2 This application has been filed on behalf of the petitioner for grant of anticipatory bail, who is apprehending his arrest in connection with Bypass PS Case No 49 of 2026 dated 21.03.2026 registered for the offence punishable under Sections 21 (b), 20, 22 of the NDPS Act.
3 In the FIR, it is mentioned that the police party reached the place of occurrence. Upon seeing the police party, the person present from before tried to flee away but one Saurabh Kumar was apprehended on the spot and he disclosed the name of the petitioner and one another person and the role attributed to the petitioner is that he was packing contraband

4 The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submitted that bare perusal of the FIR shows that the police reached the place of occurrence after making full preparation but failed to apprehend the persons present on the spot. petitioner's name has been dragged in this case on the basis of so-called disclosure made by the co-accused before the police. Petitioner is a man of clean antecedent. Attention of this Court has been drawn towards contraband seized which is little bit more than small quantity as far as brown sugar is concerned and the quantity of Ganja is very small.
5 The learned counsel for the State vehemently opposed the prayer for bail.
6 Having considered the rival submissions, clean antecedent, quantity of brown sugar which is little bit more than small quantity and the quantity of Ganja is minimal, I am inclined to grant anticipatory bail to the petitioner. 7 Let the petitioner above named, in the event of his arrest/surrender within a period of four weeks from today, be released on bail on his furnishing bonds of Rs 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount
