JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,307,504,354A and 379 of the Indian Penal Code.
The prosecution case is that on 16.7.2015 at 4 P.M. the informant was sitting in Panchayat Bhawan when the petitioner came and started abusing on protest being made the petitioner threw bricks and pelted stones on the informant when Gayatri Devi came to rescue she was also assaulted.
It is submitted by the learned counsel for the petitioner that only one lacerated injury skin deep simple in nature has been found. It is further submitted that except the informant none have received any injury. Statement to the aforesaid effect has been made in
Patna High Court Cr.Misc. No.51042 of 2015 (2) dt.10-11-2015 2/2 the supplementary affidavit. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Madanpur P.S. Case No. 102 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
