JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This application, for grant of anticipatory bail, arises out of Islampur P.S. Case No. 410 of 2017, disclosing offences under Sections 147, 149, 341, 323, 504, 447, 324, 307, 379 of the Indian Penal Code.

Allegation as per F.I.R. is that petitioners and others came variously armed and attacked the house of informant and, thereafter, co-accused Mithilesh Yadav and Arjun Yadav assaulted the informant causing head injury to him and when his wife Kanti Devi and his aunt Laxmaniya Devi came for his rescue, accused persons also assaulted them and misbehaved with the wife of informant.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.39698 of 2019(3) dt.26-09-2019 2/2 that they have falsely been made accused in this case in the background of land dispute and further there is case and counter case between the parties and no specific allegation has been attributed to the petitioners.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S. Case No. 410 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
