Prayer is for grant of bail in Wazirganj P.S. Case No. 239 of 2017 registered under section 392 IPC. The FIR was lodged against unknown.

On suspicion, the petitioner was apprehended and on his disclosure statement the stolen motor-cycle was recovered from the possession of the co-accused Uday Kumar who is stated to have been released on bail vide order dated 09.11.2017 passed in Cr. Misc. No. 52402 of 2017. The petitioner is in custody since 09.07.2017 having no criminal antecedents. Counsel for the State opposed the prayer and submitted that on his disclosure the stolen motor-cycle was recovered. After hearing both sides, the application is disposed of by

Patna High Court Cr.Misc. No.50991 of 2017(2) dt.20-11-2017 2/2 he following order:- Upon framing of charge or expiry of 05 months, whichever is earlier, if the petitioner furnishes the bail bonds in the sum of Rs. 10,000/- with two sureties of the like amount each, the trial court shall accept the same and release the petitioner on bail in connection with Wazirganj P.S. Case No. 239 of 2017 on condition that one of his bailors shall be his own/close family member.
