JUSTICE RAVI RANJAN ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner. However, none appears on behalf of the State.

Petitioner seeks bail in a case registered for offences punishable under Section 414 of the Indian Penal Code. It is submitted on behalf of the petitioner that without establishing that the concerned motor cycle was actually stolen, present case has been lodged under section 414 of the Indian Penal Code against the petitioner. It is further submitted that the petitioner has been implicated in another case arising out of the same occurrence which was lodged on the same day bearing Jalalpur P.S. Case No. 106/14 under section 393 of the Indian Penal Code and, apart from the above, no other case has ever been lodged against him.

No.48600 of 2014 (2) dt.03-03-2015 Having regards to the facts and circumstances of the case, the petitioner, namely, Rahul Yadav, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran in Jalalpur P.S. Case No. 107 of 2014 with a further condition that one of the bailors of the petitioner must be his father. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
