2. The petitioner is in custody in connection with Siswan P.S. Case No. 286 of 2021 for the offence under Section 392 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the petitioner has got five criminal antecedents and he is in custody since 04.01.2023.
4. As per prosecution case, shop of the informant was looted by some criminals.
5. Learned counsel for the petitioner has submitted that there is no evidence against the petitioner regarding looting of incriminating articles. He has been arrested merely on confessional statement of the co-accused. He has further submitted that no T.I parade has been held by the police and he
Patna High Court CR. MISC. No.46305 of 2023(2) dt.28-07-2023 2/2 has been falsely implicated in this case which is registered against unknown.
6. In view of the above, let the petitioner, named above, is directed to be released on bail after completing one year in judicial custody on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siswan P.S. Case No. 286 of 2021.
7. The petitioner will visit Siswan Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
