Heard learned senior counsel for the petitioners, Shri N.K. Agrwal and learned A.P.P. for the State. 2.

Learned senior counsel for the petitioners, after arguing vehemently for some time realising his difficulty, seeks permission to withdraw the anticipatory bail application with respect to Petitioner No. 3, Mohit Prasad Singh @ Indrajit Kumar Singh.

Permission is accorded.

Accordingly, the anticipatory bail application is dismissed as withdrawn with respect to Petitioner No. 3, Mohit Prasad Singh @ Indrajit Kumar Singh.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 303(2), 324(4), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita.

Learned senior counsel for the petitioners submits that Petitioner Nos. 1 and 2 are persons with clean antecedent and the informant alleges that on account of dispute relating to land, on orders of Ranjesh, accused Mohit assaulted Vijay (brother of informant) by an iron rod causing injury on head, thereafter accused persons assaulted his family members by lathi and danda, and Mohit also broke the mirror of his vehicle. 7.

Learned senior counsel appearing on behalf of the petitioners submits that petitioners have been falsely implicated in the instant case on account of dispute relating to land. It is next submitted that the specific allegation of assaulting the brother of the informant is against Mohit, who is alleged to have caused injury on head, which has been opined to be grievous and as far as the petitioners are concerned, the allegation against them is general and omnibus in nature.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned

No.42131 of 2025(2) dt.09-07-2025 3/3 senior counsel for the petitioners, the petitioner Nos. 1 and 2, above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Supaul P.S. Case No. 828 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.
