JUSTICE RAVI RANJAN ORAL ORDER 12-02-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 406, 409, 420, 465, 468, 471 and 120B/34 of the Indian Penal Code.

It is contended on behalf of the petitioners that they are Ward Members and, as would be evident from the order of the Sessions Judge, the beneficiaries have supported the defence version before the police in their statement under Section 161 Cr. P.C. that the B.P.L. Card and kerosene oil coupons were distributed amongst them. It is further contended that co-accused Subhash Kumar Chaudhary, who was responsible for distribution

Patna High Court Cr.Misc. No.51496 of 2015 (4) dt.12-02-2016 of the same, has already been granted anticipatory bail by the court below itself.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Raj Kumar Mahto @ Raj Kumar and Hari Prasad Yadav @ Hare Krishna Prasad be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Sadar P.S. Case No.283/2012, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
