The petitioner seeks bail in S.Tr. No. 328 of 2018, arising out of Deepnagar P.S. Case No. 93 of 2018, instituted for the offences under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that there is allegation in the written report that one Yugal Yadav opened fire on the chest of the victim and he succumbed to injury. The allegation against this petitioner is that he caught hold the victim from one side. He is in custody since 23.03.2018.

Patna High Court Cr.Misc. No.63506 of 2018(4) dt.06-11-2018 2/2 The supplementary affidavit, has been filed today in this court, stating that other cases are also pending against the petitioner.

Considering the fact that there is no specific overt act alleged against the petitioner, the prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ VIIth, Nalanda at Biharsharif, in connection with S. Tr. No. 328 of 2018, arising out of Deepnagar P.S. Case No. 93 of 2018. Both the bailors will be close relative of petitioner.
