The petitioner seeks bail in anticipation of his arrest in connection with Jokihat (Mahalgaon) P. S. Case No. 143 of 2020, dated 07.05.2020, instituted for the offences under Sections 341, 323, 324, 307, 379, 427, 504, 506 and 34 of the Indian Penal Code.

Patna High Court CR. MISC. No.39678 of 2020(3) dt.07-07-2021 2/3 The accusation against the petitioner is of having given a Dabia blow on the informant resulting in simple injury.

There is a counter version of the occurrence as well.

The learned counsel for the petitioner has submitted that the occurrence arose out of a very petty dispute regarding plucking of maize.

Regard being had to the fact that there is no reference of any assault on the side of the accused persons and the injury on the informant being simple in nature, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jokihat

Patna High Court CR. MISC. No.39678 of 2020(3) dt.07-07-2021 3/3 (Mahalgaon) P. S. Case No. 143 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C. The application stands allowed.
