2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Deo P.S. Case no. 14 of 2025 instituted for the offence under Sections 190, 191(2), 126 (2), 115(2), 117(2), 303, 109, 352 and 353 of the BNS 2023.
3. The case of the prosecution is that on account of some land dispute altercation took place between the informant and the petitioner side, leading injury to both sides. There is case and counter case between the parties. The counter case filed by the petitioner's side is SC/ST P.S. Case No. 4 of 2025 registered for the offence punishable under Sections 190, 19192), 126(2), 115(2), 117(2), 303, 109, 352 and 353 of the
Patna High Court CR. MISC. No.45659 of 2025(2) dt.04-08-2025 2/3 BNS, 2023.
4. Learned counsel for the petitioner has submitted that petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that from perusal of the FIR itself, it is clear that the main thrust of allegation is against Dhananjay Paswan and the nature of allegation against this petitioner is general and omnibus. It is also submitted by the learned counsel for the petitioner is that co-accused persons, namely, Jitendra Paswan, Dhananjay Paswan and Nandu Paswan has been granted bail by a coordinate Bench of this Court vide order dated 12.05.2025 passed in Cr. Misc. No. 29227 of 2025.
5. Learned APP appearing for the State opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Deo P.S. Case no. 14 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.45659 of 2025(2) dt.04-08-2025 3/3 satisfaction of learned Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under section 438(2) of the Cr.P.C/ Section 482 (2) of the BNSS.
