Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 328, 376(2)G/34 of the Indian Penal Code.

Accusation is of kidnapping the informant by the petitioner and co-accused Rupak Kumar Singh, Guddu Singh and she was being ravished by them.

It is submitted by the learned counsel for the petitioner that petitioner is a disable person and there is material contradiction between the accusation levelled in the prosecution case and the statement of the victim in 164 Cr.P.C. Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Vidyapati Nagar P.S. Case No. 124 of 2015,

Patna High Court Cr.Misc. No.51046 of 2015 (2) dt.09-11-2015 pending in the court of learned Sri P.K. Roy, J.M., Ist Class, Dalsingsarai, Samastipur.

With the above observation this application is disposed of.
