JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-11-2018 Petitioner prays for bail in connection with Baruraj P.S.Case No. 158 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code.

Allegation as per FIR is that the informant while coming from his shop was intercepted by some miscreants and his articles were looted away and thereafter on chase the petitioner and other co-accused were arrested and it is said that looted articles were recovered.

Submission of learned counsel for the petitioner is that the looted articles have never been put on T.I. parade and moreover co-accused Chhotan Singh, who was also apprehended at the spot, has already been granted bail by coordinate Bench of this Court vide order dated 6.10.2018 in Cr.Misc.No. 58254 of 2018.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Ms. Priti Kumari, Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Baruraj P.S.Case No. 158 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
