The petitioners apprehend arrest in a case registered for the offences punishable under sections 365, 366A,504/34 of the Indian Penal Code. The informant alleged that Sahil alias Shut Paswan kidnapped his minor daughter. It is alleged that when the informant went to enquire, petitioners are said to have disclosed that his daughter would not come.

It is submitted that the entire allegation is false. Petitioners are mother and brother of Shut Paswan, who is said to have kidnapped the victim girl. There is no material to show that the petitioners took part in kidnapping of the victim.

Patna High Court Cr.Misc. No.51270 of 2015 (2) dt.15-12-2015 Considering the fact that the petitioners are mother and brother of Sahil @ Shut Paswan and no tangible material is collected against them, the petitioners above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Tisiauta P.S. Case No. 49 of 2015 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
