The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379 and 302 of the Indian Penal Code. The informant is not an eyewitness of the occurrence, nor the case diary would reveal that any other eyewitness has occasion to witness the actual occurrence. But only the victim of injury, while he was being carried to the hospital, disclosed the name of the petitioner and others as his assailants.

Submission is that petitioner has got no criminal antecedent and there is no direct evidence against the petitioner. Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.61120 of 2018(3) dt.06-11-2018 2/2 aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Bihta Police Station Case No.596 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
