The petitioner apprehends his arrest in connection with Katihar Town (S) P.S. Case No. 705 of 2016 registered under Sections 341, 342, 323, 504, 427 and 307/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the family of the informant has constructed the house over the land belonging to the temple and the father of the petitioner, who is an Advocate, has filed an application before the Circle Officer to remove the encroachment over the land of the temple due to that reason the informant lodged the present case with false allegation taking advantage of his illness. Further submission is that no any external injury was found on the informant by the Doctor of

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Katihar Town (S) P.S. Case No. 705 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
