The petitioner is in custody in connection with Gaya Kotwali P.S. Case No.210 of 2016, a case under Section 392 of the Indian Penal Code.
The F.I.R. of occurrence of robbery is against unknown. During investigation the petitioner was apprehended and his confessional statement was recorded.
Submission is that the petitioner is in custody since 25.11.2016. He was never put on Test Identification Parade during investigation nor anything has been recovered from his possession nor the confession before police is legal evidence in the eye of law.
Patna High Court Cr.Misc. No.57232 of 2017 (3) dt.05-01-2018 P2/ Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gaya Kotwali P.S. Case No.210 of 2016, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
