The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 297 of 2016 registered under Section 409 of the Indian Penal Code.

The allegation against the petitioner is of criminal breach of trust.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case with ulterior motive. In fact, the petitioner joined in the year 2012 and took the charge from the previous Panchayat Secretary on 19.09.2016, who did not give the relevant documents with regard to the appointment of teachers, which

Patna High Court Cr.Misc. No.1349 of 2017 (2) dt.17-01-2017 2/2 would appear from Annexure nos.-2 and 3 of this application, so he was unable to submit the relevant documents to the concerned authorities.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Siwan in connection with Siwan Muffasil P.S. 297 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
