JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 Petitioner prays for bail in connection with Islampur P.S.Case No. 263 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504, 506 and 379 of the Indian Penal Code and later on Section 302 IPC was added.
Allegation against the accused persons, including the petitioner is of assault to the deceased.
Submission of learned counsel for the petitioner is that she is a lady and there is no specific allegation attributed against her and she is in custody for more than three months. Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail that for withdrawal of a case the occurrence took place and accused persons, including the petitioner have assaulted and due to
Patna High Court Cr.Misc. No.61248 of 2018(3) dt.05-11-2018 2/2 assault he succumbed to the injuries.
Having heard both sides and in the facts and circumstances, and considering the fact that petitioner is a lady, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Islampur P.S.Case No. 263 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
