1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 32(3) and 41 of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent.

4. Allegation is of recovery of 530 litres of liquor from the bank of a river in four boats.

5. Learned counsel for the petitioner submits that petitioner is not the owner of the boat and he came to be implicated for the reason that he was a passerby when the raid was conducted. It is further submitted that police in a mechanical manner implicate without holding a proper investigation. It is next submitted that petitioner is in custody

6. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

7. Considering the aforesaid submissions, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Parsa P.S. Case No. 76 of 2024.
