This application has been filed under Section 482 of Cr.P.C. to quash the order dated 28.09.2012 passed in Complaint Case No. 2158 (C) of 2012, whereunder the Court of Judicial Magistrate, 1st Class, Patna, on inquiry under Section 202 Cr.P.C.

Patna High Court Cr.Misc. No.31790 of 2013 (5) dt.04-04-2017 2/2 summoned the accused petitioners for the offence under Sections 406 and 120(B) of Indian Penal Code and also under Section 138 of N.I. Act to accused petitioner Danish Ahmad.

On going through the impugned order, I do not find any illegality amounting to abuse of process of Court for interference in extraordinary jurisdiction under Section 482 Cr.P.C. Accordingly, this application is dismissed. However, the petitioner would be at liberty to raise his defence in the trial court at appropriate stage. (Rajendra Kumar Mishra, J) manish/- U T
