Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B)/34/201 of the Indian Penal Code.
The petitioner is husband of the victim of dowry death. Petitioner is in custody since 12.08.2017. Earlier prayer for bail was refused on 14.12.2017.
The report of the learned trial judge would reveal that charges have already been framed in the case. However, no prosecution witness has turned up till now.
Considering the period already undergone by the petitioner as under trial prisoner as well as the fact that trial is not going to conclude in near future, let the petitioner, above
Patna High Court CR. MISC. No.40015 of 2019(4) dt.26-09-2019 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Sikandra Police Station Case No.46 of 2017, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
