The petitioner seeks bail in Samastipur Muffasil P. S. Case No. 493 of 2018 instituted for the offence under Section(s) 30(a), 36, 47 of the Bihar Prohibition and Excise Act, 2016 and Sections 272, 273, 353, 307, 279 and 427 of the IPC. In the written report, it is alleged that police got information that Sumit Mahto who indulged in sale and purchase of illicit liquor is to bring the consignment near the house of his brother, namely, Santosh Mahto. On this information, the police intercepted one vehicle as mentioned in the written report on which Santosh Mahto was sitting and this petitioner was driving the vehicle. It is alleged that huge
Patna High Court Cr.Misc. No.63330 of 2018(3) dt.26-10-2018 2/2 quantity of illicit liquor has been recovered from the aforesaid vehicle.
Learned counsel for the petitioner has submitted that petitioner is the driver- cum- owner of the alleged vehicle, which was used for public utility. He has no concern with illicit liquor recovered from the vehicle.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge VIth cum Special Judge Excise, Samastipur in connection with Samastipur Muffasil P. S. Case No. 493 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
