Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Lauria P.S. Case No. 96 of 2015 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 307 and 302 of the Indian Penal Code.

Allegedly, this petitioner and co-accused persons caught hold the brother of the informant and started assaulting him and thereafter forcefully took him in their house and closed the victim inside a room and then informant raised an alarm and after that villagers of the informant gathered there and freed the victim from the clutch of the accused persons and later on during the course of treatment the informant's brother died.

No.43684 of 2022(2) dt.24-11-2022 2/2 The main submissions advanced by the learned counsel Mr. Shiv Kumar Dwivedy for the petitioner are that the petitioner is a widow lady, against her there is no specific allegation in the FIR and other co-accused who are relatives of the petitioner are on bail granted by different Benches of this Court vide orders passed in Cr. Misc. Nos. 26432 of 2016, 48224 of 2016, 32856 of 2017, 50075 of 2015 and the petitioner has clean antecedent.

Learned APP Md. Aslam Ansari appearing for the State has opposed the bail prayer.

In view of above submissions and mainly considering the facts that the petitioner is stated to be a widow lady and against her there is no specific allegation in the FIR and similarly situated co-accused persons mentioned-above are on bail, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Lauria P.S. Case No. 96 of 2015.
