JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 498A, 328 and 304B/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after six years of the marriage for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioner that due to strong abdomen pain, the victim was admitted in the hospital where she died due to cardiac arrest. The postmortem report does not reflect any injury. Cause of death has not been assigned, though, viscera has been reserved. After going through the case diary, the co-ordinate Bench of this Court has granted

Patna High Court Cr.Misc. No.53071 of 2015 (2) dt.23-11-2015 2/2 anticipatory bail to the husband of the petitioner vide Cr. Misc. No. 30425 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jamui in connection with Sono P.S. Case No. 57 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
