The petitioners have filed this writ petition for handing over the possession to the petitioners over the lands settled in their favour under Section 27 of the Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, 1961 after the land being declared surplus but the respondent Nos.8 to 12 are interfering into the possession of the petitioners.

On the face of it, it appears that dispute relates with the settled land of the petitioners and for such, there is a provision under the Bihar Land Disputes Redressal Act and the Dy. Collector Land Reforms is competent authority to pass order, if any person dispossess the settlees of the lands settled in

Patna High Court CWJC No.20907 of 2014(3) dt.03-12-2018 2/2 their favour under Section 27 of Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, 1961. In view of the fact, this writ petition is disposed of with a direction to the petitioners to present the proper petition before the D.C.L.R. under Bihar Land Disputes Redressal Act and on such, D.C.L.R. shall dispose of the case of the petitioners within four months from the date of presentation of the petition. With the aforesaid direction, this writ petition is disposed of.
