The petitioners apprehend their arrest in Sahebganj (Muzaffarpur) P.S. Case No. 69/2015, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
The father of the deceased made allegation that his daughter was married with Mantu Shah who were living in Jamnagar, Gujarat for his livelihood. The informant alleged that her father-in-law, mother-in-law, brother-in-law and sister-in-law assaulted his daughter and killed her after throttling. It is submitted that the petitioners are sister-in-law and brother-in-law of the deceased. They were living separately and
Patna High Court Cr.Misc. No.35135 of 2015 (3) dt.02-11-2015 2/2 they have no manner of concern with the family affairs of the deceased and her husband, but from perusal of the FIR, it appears that witnesses have stated that they heard alarm inside the house. Balendra Shah and Bhola Shah and their wives are said to have assaulted the victim. From perusal of post-mortem report, it appears that many injuries were found on the person of the deceased.
Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
