The petitioners are apprehending their arrest in a case
Patna High Court Cr.Misc. No.369 of 2017 (2) dt.10-01-2017 2/3 registered under Sections 147, 148, 341, 323, 324, 307, 504 and 379 of the Indian Penal Code.
The prosecution case, in brief, is that on the alleged date and time of occurrence while the informant along with his father was working in the field, the accused persons including the petitioners variously armed reached there and surrounded them and on the order of Sadanand Yadav, accused Gitan Yadav hit in the galphar of the informant's father with an arrow and then the accused persons brutally assaulted the informant and his father. It has been submitted on behalf of the petitioner that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. General and omnibus allegation has been made. No specific injury has been attributed against the petitioners. The main allegation has been made against the co-accused Gitan Yadav. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like
Patna High Court Cr.Misc. No.369 of 2017 (2) dt.10-01-2017 3/3 amount each to the satisfaction of Sri K.K. Deo, Judicial Magistrate, Supaul in connection with Jadia P.S. case No.116 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
