JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Parasbigha P.S. Case No. 210 of 2019 for the offence under Sections 25(1-B)a, 26, 27 and 35 of the Arms Act. Learned counsel for the petitioner submits that during search, the police recovered a loaded Desi Katta and one cartridge from co-accused Deepak Ram and nothing was recovered from the possession of the petitioner and petitioner is in custody since 11.10.2019 whereas co-accused Deepak Ram from whose possession arms has been recovered, has been granted bail by a coordinate Bench of this Court vide order dated 28.02.2020 passed in Cr. Misc. No. 12213 of 2020.

Patna High Court CR. MISC. No.38845 of 2020(2) dt.10-02-2021 2/2 Considering the aforesaid, the Court is inclined to grant bail to the petitioner. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Parasbigha P.S. Case No. 210 of 2019.
