JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 Petitioner prays for bail in connection with Bahadurganj P.S.Case No. 92 of 2018, giving rise to Special POCSO case no. 19 of 2018, registered for the offences punishable under Sections 363, 366A, 341, 323, 379 and 34 of the Indian Penal Code.

Allegation of kidnapping of minor daughter of the informant is against one Anand Kumar and his family members and later on name of petitioner transpired in the statement of the victim girl recorded under Section 164 Cr.P.C. Submission of learned counsel for the petitioner is that the statement of victim disclosed that petitioner has only taken the girl along with Anand and allegation of rape is against Anand and not against the petitioner, who is in custody for more than three months and charge sheet has already been submitted.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, POCSO Act, Kishanganj, in connection with Bahadurganj P.S.Case No. 92 of 2018, giving rise to Special POCSO Case No. 19 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
