JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 18-02-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Vishnupad P.S. Case No. 38 of 2019 (G.R. No. 990 of 2019) instituted for the offences under Sections 363, 366(A) and 34 of the Indian Penal Code.

Learned counsel has taken this Court to the statement of the prosecutrix who is 21 years of age and she has stated that she has gone on her own will and she was not abducted and she was married Ram Paswan.

Taking into consideration the statement under Section 164 of the Criminal Procedure Code, I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
